1. Our Role as an Intermediary (Commercial Agent)

Kapco Travel Services (hereinafter "the Company," "we," or "us") acts exclusively as a Destination Management Company (DMC) and a commercial agent for independent third-party service providers (the "Suppliers").

When you book an excursion through our website, your contract for the service is directly with the Supplier. The Company facilitates this transaction but is not the provider of the actual excursion, transport, or activity.

2. Limitation of Liability & Third-Party Disclaimer

  • No Operational Control: All excursions, activities, and transport services are owned, controlled, and operated by independent Suppliers. These Suppliers are not employees, partners, or direct agents of the Company.

  • Disclaimer of Responsibility: The Company shall not be held liable for any injury, loss, death, property damage, delay, or irregularity caused by the acts, omissions, or negligence of any Supplier or third party.

  • Accuracy of Information: While we strive to ensure all descriptions on our site are accurate, all content (images, itineraries, inclusions) is provided by the Suppliers. We are not responsible for minor variations in the "experience" compared to the website descriptions.

  • Force Majeure: The Company is not liable for cancellations, delays, or changes caused by events beyond our control, including but not limited to extreme weather, strikes, or local government restrictions.

3. Customer Responsibilities & Transfers

  • Safety & Fitness: By booking, you certify that you meet the health and physical requirements for the activity (e.g., swimming ability for boat tours).

  • Timeliness: Customers are responsible for arriving at the designated meeting point at least 15 minutes prior to departure. No refunds will be issued for "no-shows" or late arrivals.

  • Insurance: We strongly recommend that all customers maintain comprehensive travel and medical insurance. Our booking prices do not include personal insurance.

  • Supervision of Minors: All children and minors (under the age of 18) must be accompanied by at least one responsible adult for the entire duration of the excursion.

  • Right to Cancel: If a booking is made for a minor without a corresponding adult participant, or if the minor arrives at the meeting point unaccompanied, the Company and/or the Supplier reserve the right to cancel the reservation immediately without a refund.

  • Transfers & Child Safety Seats: Where an excursion includes vehicle transfer, please note that baby chairs/child safety seats are not included as standard. *It is the customer's
